Mumbai, Apr 4 (PTI) A court here on Friday issued a show-cause notice to the Mumbai police for not submitting their inquiry report in a complaint of defamation and stalking filed by former NCB zonal director Sameer Wankhede's sister against NCP leader Nawab Malik.
Additional Chief Judicial Magistrate (Bandra), Ashish Awari, had in January this year ordered an inquiry under the Code of Criminal Procedure (CrPC) section 202 which deals with postponement of the issue of process against an accused. It gives the magistrate the power to inquire into the case or direct an investigation.
The court had directed the police to submit its report after inquiry.
However, the probe agency is yet to file it.
The show-cause notice has been issued to the Amboli police station in Jogeshwari.
In her complaint, filed through advocate Ali Kaashif Khan Deshmukh, the Indian Revenue Service (IRS) officer's sister Yasmeen Wankhede accused Malik, a former state minister, of making false, defamatory and scandalous allegations against her in various tweets and television interviews, and stalking her on social media platforms.
The complaint was originally filed before an Andheri court in 2021 and later transferred to MP/MLA court in Bandra.
The complainant stated that Sameer Wankhede, during his stint as the Mumbai Zonal Director of the Narcotics Control Bureau (NCB), was actively involved in busting drug rackets and handling various 'high-profile drugs-related cases.
One of the cases being handled by her brother was against Malik's late son-in-law Sameer Khan, it said.
"Out of the personal grudge and vengeance held against the complainant's brother for taking legal action against his son-in-law, the accused (Malik) as a counter-measure and counter-blast started making false, defamatory and baseless allegations against the complainant and her family members," the complaint said.
It added that the attempt was made with a "malafide intention" to pressure the family. PTI AVI NP
